And you know perfectly well that if the Supreme Court says it is constitutional then it is. Don't make it right; they've been wrong before on Dred Scott, Prohibiton and other issues. But it does make it constitutional!

Here's what the Supreme Court says on the matter.
When the Supreme Court rules on a constitutional issue, that judgment is virtually final; its decisions can be altered only by the rarely used procedure of constitutional amendment or by a new ruling of the Court. However, when the Court interprets a statute, new legislative action can be taken.
