Why? Judges are supposed to uphold the law and if the executive breaks the law judges have the right to declare the executive action unconstitutional. Or would you rather simply get rid of any kind of check on the executive branch of government? That way leads you to the authoritarian states of Hitler, Stalin, Mao, Pol Pot and their imitators.

Agree with you in theory Mike. However, reality here is that Democrat American Presidents have stacked the US Ninth Circuit Court of Appeals with loopy radicalized far-left judges. They have a sorry track record of trying to create, or modify, laws from the bench rather than following them. I'm sure they'll try to do the same thing in this instance. Just have to hope that Trump stays in office long enough to adjust the makeup of that court as some of those justices die off.

FDR's executive order to put US citizen's of Japanese, German + Italian descent in prison ( internment camps ) was not challenged by any dissenting federal judge.

Presumably you imagine that they were motivated by a liberal agenda in not challenging that decision?
