A state Supreme Court judge in Buffalo refused a request by Nushawn Williams' lawyer to throw out the attorney general's case to have Williams held indefinitely under a civil-confinement law. Defense attorney Daniel Grasso had argued that Williams isn't subject to that 3-year-old law because it was passed after he had finished a sentence for statutory rape and while he was serving time for reckless endangerment. But the judge agreed Monday with the state that sentences merge together in prison. Williams' civil confinement trial is set for October. I don't think this is the right way to go about things.
If you sentence someone to a fixed term then they shouldn't IMHO serve LONGER than that without being given a fresh trial.
I'm all for sentencing sex offenders to LWOP but of course it's becoming (sadly) increasingly common for people in America to be incarcerated without even having a trial.
For instance, in Pennsylvania if a man is accused of domestic violence he is held in custody until he confesses.
If he denies that any abuse took place he can be held in prison indefinitely without any kind of due process, formal charges or whatever.
He is even required to 'describe' the abuse which he inflicted even if he never did it at all.
Like with sex offenders, I'm anything BUT keen on DV offenders but everyone has the right to due process and a fair trial.
Otherwise we might as well as give up!

As far as violent sex offenders and predators that knowingly infect their partners with AIDS go I believe in permanent segregation for their safety and our safety! I like the Russian idea of exile after prison! Psychiatric clinics are too expensive and a waste of resources for violent sex offenders. A labor camp isolated from the rest of society sounds reasonable!
I refuse to play Russian roulette with the innocent by releasing violent predators into society and i have no interest in prosecuting those who in an act of civil disobedience commit a vigilante act to ensure that the predator doesn't strike again!

Isn't that more than just a sex offense? Since it is a terminal disease with no known cure couldn't you charge them with some type of homicide charge if he didn't use a condom?
