A Palestinian man has been convicted of rape after having consensual sex with a woman who had believed him to be a fellow Jew.
Sabbar Kashur, 30, was sentenced to 18 months in prison on Monday after the court ruled that he was guilty of rape by deception. According to the complaint filed by the woman with the Jerusalem district court, the two met in downtown Jerusalem in September 2008 where Kashur, an Arab from East Jerusalem, introduced himself as a Jewish bachelor seeking a serious relationship. The two then had consensual sex in a nearby building before Kashur left.
When she later found out that he was not Jewish but an Arab, she filed a criminal complaint for rape and indecent assault.Full article

Consider the scenario where an identical twin claimed to be the other one whom the lady in question wanted to sleep with, as she did not want to sleep with him. Would that be rape? If one would answer yes to that, then I suppose it comes down to where you would draw the line for when the differences between the actual identity and wrongly believed identity, cross it. Or is it the case that 'mistaken' or 'mislead' consent is still consent?

What about the twin scenario where she never would have slept with twin A who is pretending to be B, and A knows this? She did not give consent for A to have sex with her.

Well they would have to be a miracle in twindom to be so identical that she couldn't tell the difference. If she said 'yes' she gave consent. It's her responsibility to ensure she is boinking the right person - not the laws.

If it's consensual sex, it can't be rape. End of. The stupid girl is just trying it on! That would certainly be the case under English law, I think. I can remember a few cases where the woman claimed that had she known the truth, she would never have consented -including one from a prostutute who was never paid. None of them resulted in a rape conviction. But even if she was conned, consent is still consent here at least. Not sure about the false penis story though, because that wasn't what she was agreeing to.

I can only think of the the true story of a transexual female, which was made into a movie entitled "Boys Don't Cry". Hillary Schwank played the role in the film of this individual. Some would of course argue that transsexuals have the soul or identity of the opposite sex and thus are of that gender, despite the anatomy.
This thread story is an Israeli court case and would never fly here! The Palestinan Israeli relations are in very bad shape.
I thumbed through a book, written for guys who want to get a girl quick. The author among other tricks carried a tennis trophy around and claimed he was a professional tennis player. He claims to have gotten a number of women that way!
It's conceivable that the "victims" could file a civil suit against this author, but i don't think the plaintiffs could get much, if anything!

If I tell a woman that I'm a billionaire, a medical doctor, and the owner of a racing sailboat entered in the America's Cup race she might wonder why I'm driving a Ford.
When I take her back to my place for sex she might wonder why we're in an apartment rather than a huge estate with servants and grounds?
If she can't connect the dots then she's not smart enough to fend off the opportunist. He's not a rapist. He's just a horny guy looking for a gullible woman he can take advantage of.

The mirror twin thing comes in though.....in that he is right handed, his brother is left handed. I have been around them the two of them numerous times and it freaks me out completely. I will have to talk to her and see what her thoughts are on this......since it is something she could maybe understand.

One-time students of English criminal law may remember the case of R v Collins, concerning a young woman who left a ladder outside her bedroom window for her boyfriend, and a young man who climbed up it. As he climbed through the window, the girl invited him into her bed, but after a while realised that Collins was not her boyfriend and raised the alarm. Significantly, he wasn't charged with rape, but with burglary with intent to rape; it gave academics hours of fun deciding how much (and which bits!) of someone's body has to be in a house before it can be trespass.
