Oh OK - if Collins realised when he was invited in (as opposed to on hindsight) that she was mistaking him for her boyfriend, there really is nothing to choose between the two cases and Morales wasn't a rapist either. I can't explain why the law is different for married women who make the same error; I'd have to read the cases. You might be lucky to find Collins anywhere, but it is worth having a look. i know you posted the link that summarized it. i'd like to see the text of the decision, such as i posted with morales. i haven't been able to find it yet. reading court decisions is time consuming as hell, since you have to read the cites also. i once wrote a five page brief in twenty minutes, but it took about sixty hours of reading to do it.

Collins pre-dates the internet so I'm not sure you can get it via Google. What makes you so sure Collins admitted he knew he had been mistaken for the boyfriend?

What makes you so sure Collins admitted he knew he had been mistaken for the boyfriend? he told the cops that he thought that she believed that he was victor coming back to have sex. she had wanted victor to stay for the night, but he had something to do in the morning.
