What about VietNam then? That was never declared as an official 'War' either. What about the First Iraqi War with Bush Snr?

No expert here, but I think the U.S. and SEATO members, went into Vietnam at the request of the government of South Vietnam to support their resistance to an invasion by North Vietnam. Lin would know more about it, no doubt. the government is right. the courts have no say in military matters. the president is commander in chief of the armed forces first of all, and secondly, dumbya had congressional authorization for the iraq war

The Iraq war was the right thing to do at the time. Bush was the biggest Presidential upgrade (over his predecessor) in our history. Obama is the biggest Presidential downgrade in our history. It's interesting that GW Bush was sandwiched between those two.
There aren't any mothers of Revolutionary War soldiers alive today but I'll bet they'd complain about their boys being sent to war too.

That is partially correct. SEATO was created in 1955 for that reason, and in so doing, violated the Geneva Agreement. Eisenhower knew, as did most of the West, that Ho would win the national election by about 75%.
