The alleged abuser was known for his horse-grooming abilities, Harmon said. The father returned to the house, caught the man in the act, and stopped him by striking him in the head several times, Harmon said. The man was pronounced dead on the scene, while the daughter was taken to a local hospital in Victoria, Texas, for examinations before being released. The incident took place Saturday. Harmon described the girl as "OK besides the obvious mental trauma." Asked whether they would press charges against the father, the sheriff responded, "You have a right to defend your daughter. He acted in defense of his third person. Once the investigation is completed we will submit it to the district attorney who then submits it to the grand jury, who will decide if they will indict him." Harmon described the dad as "very remorseful," adding that he didn't know the man was going to die. Authorities were withholding the deceased man's name while they notified next of kin. Officials did not know immediately if he has a prior criminal history.

Oh, you can't blame a father for that.. Nor can I, But I also can't blame the law for punishing him for taking the law into his own hands, that's if it wasn't a case of diminished responsibility.

There is a thin line between self defence and revenge; this may be more of the latter than the former. I also sympathise with the father, but I doubt if it was necessary to kill the man to stop him abusing the girl - a witness would be enough for most I'd have thought!

You said that he didn't take the law into his hands. So either he had diminished responsibility, or the law (rather bizarrely) defines a punishment beating as 'defence'. Otherwise he took the law into his own hands. You can state as often as you like what the law in Texas is, and how you agree with it. I don't have to agree that a civilised system of law and order let's citizens appoint themselves judge jury and executioner and kill eachother with just their word that the other person was attempting to steal their pen.

When your adrenalin is set to work, it takes a few moments for it to stop. Or if it's not adrenalin, it takes a few moments for your brain to register that you are no longer in danger. I can't tell you where or when or how but I know this feeling.
One time I heard the dreadful news of the death of a friend; he was very young and it was out of the blue, a drowning accident. It had been on the news all night but I didn't for a moment think it was him so when his girlfriend arrived at my door the next day and correctly assessed that I didn't know, and began to tell me, and I began to realise that he was the guy in the news.... well, I guess I went into some shock because I recall saying ''No'' a few times, not in any fainthearted or dramatic way but just matter-of-fact: no. Nope. No. (Denial.)
And I was also aware somewhere that I was saying it, and should stop, because she wasn't lying, was she. But I had no control over what I was saying or doing. None at all! It was as if one part of me was registering the information but another part of me was doing something else.
And I imagine it's the same in any traumatic scenario. We don't choose to say or do something, we just do or say it. The father registered the danger to and attack on his little girl & he just went into to fight mode. A father's natural instincts. Maybe anyone's. But I know from being a mother how deep & uncontrollable instinct can be.
Had this man left and returned, one could argue murder. But this was a version of self-defence. He just took more time, and fought more strongly than he needed to, but he didn't have a choice. When your child walks in front of a car, you can defy physics to grab her and snatch her out of harm's way.

The flimsy pretext comes from the fact that it is the private citizen who decides guilt and not a court. So I can say that I saw anyone I wished to bump off take my pen and so I decided to punish them with the death penalty on the spot. And according to you the law should allow this, rather than insisting that things be done properly, ie that it is the court that decides guilt and if that is the case, only then is the person executed.
The mafia and the mob must have a field day under these laws which amount to a private citizen's charter to kill whomever they wish on a flimsy pretext. 'I never whacked him he was attempting to steal my pencil sharpener'.
And yes I know you are not saying that citizens should be able to bump off whoever they like or be judge jury and executioner, but it is what the law you advocate amounts to.

I know there are convictions for crimes of passion.....that essentially lessen the conviction of murder.....the definition is "defendant's excuse for committing a crime due to sudden anger or heartbreak, in order to eliminate the element of "premeditation."
I would think this crime would be somewhat in that category.......the scene before you is SO BAD....that your reaction is extreme and some what uncontrollable.
I can't say I would know when to stop hitting the person that harmed my child.
